Item Fashion Law’s New Imperative: Reforming Intellectual Property Frameworks to Safeguard Original Designer Creativity in the age of Generative Artificial Intelligence(NLUJAA, 2026) Lamia Himayat KidwaiGenerative AI systems such as ChatGPT, Gemini, Midjourney, DALL-E, Stable Diffusion, and other machine learning models can create text, images, music, videos, software code, and designs based on instructions provided by users.1 These systems are capable of producing sophisticated outputs within seconds, often with very little human intervention. As a result, AI has become a valuable tool for businesses, creators, researchers, artists, designers, and technology companies. The growing use of AI has created new opportunities for innovation and economic growth. It has improved efficiency, reduced production costs, and enabled individuals and organizations to generate creative content on a large scale. However, the increasing ability of AI systems to create original-looking works has also raised significant legal concerns, particularly in the field of Intellectual Property Rights (IPR). Artificial Intelligence (AI) has become one of the most important technological developments of the modern era. It has transformed the way people work, communicate, create, and access information. From healthcare and education to finance and entertainment, AI is now being used in almost every sector of society. In recent years, the development of Generative Artificial Intelligence has further expanded the capabilities of technology by enabling machines to generate content that was traditionally created only by human beings.
