The research intends to thoroughly analyse and assess the legal and jurisprudential structure of the Protection of Plant Varieties and Farmers’ Rights Act, 2001 (PPVFR Act) in India, especially regarding its classification as a sui generis system for plant variety protection. It aims to evaluate if the Act significantly diverges from traditional breeder-focused intellectual property frameworks or simply mimics them while pretending to adhere to TRIPS standards. The study also seeks to examine the extent, characteristics, and enforceability of farmers' and community rights under the legal framework, concentrating on uncovering structural uncertainties, doctrinal constraints, and practical obstacles to their application.
