Abstract
The primary aim of this study is to critically examine the role of the International Criminal Court
(ICC) in establishing individual criminal liability for the commission of war crimes under
international law. The study seeks to assess the effectiveness of the ICC’s legal framework,
institutional mechanisms, and prosecutorial strategies in achieving justice for victims of war
crimes. It also aims to explore the challenges and limitations that hinder the ICC’s capacity to
prosecute such crimes—particularly in contexts involving non-state actors, state non-cooperation,
and political interference
