Abstract
This dissertation examines the growing issue of fake news, digital misinformation, and political propaganda in the context of the Indian electoral and democratic framework. The study primarily focuses on the influence of politically motivated misinformation on voter behaviour and public opinion during elections and political campaigns. It analyses the nature, forms, and methods through which fake political content is disseminated through digital platforms and social media intermediaries such as YouTube, Facebook, and X. The research further explores the applicability and effectiveness of the Copyright Act, 1957 and the Information Technology Act, 2000 in addressing unauthorized use, manipulation, and dissemination of political content, including speeches, campaign materials, videos, and media broadcasts. Particular emphasis is placed on intermediary liability under Section 79 of the Information Technology Act, 2000 and the Intermediary Guidelines governing digital platforms.
