They have now become vital instruments of brand recognition, consumer trust, and market power. Over the years, substantial legal policy efforts have been developed for protecting trademarks against misuse, particularly in the form of trademark squatting. Traditionally, this issue has been addressed through the strengthening of national and international intellectual property (IP) regimes, reforms in registration systems, and participation in multilateral treaties like the Madrid Protocol. These measures have largely been designed to respond to conventional cases of trademark squatting, typically involving human actors exploiting the “first-to-file” rule in jurisdictions like China, India, and Brazil to seize legal control over marks not yet registered by their rightful owners.
